Terms and Conditions

These terms and conditions (“Terms”) govern the booking and delivery of orders between Our Selling Company, Hemank Auto Parts Private Limited (“Company”) and, you the client (“Client”). By making a booking with us, you agree to comply with and be bound by these Terms and Conditions.

1. Booking in Advance

   1. Payment: Client must secure their booking(s) with the above mentioned payment of Rs. 49,000/- . The client certifies that this payment is made entirely upon his own wish / will / choice without any type of compulsion or demand whatsoever laid upon by the Company.

2. Order Confirmation / Cancellation

   1. Cancellation by the Client: The Client understands and accepts that he / she / they do not have the right to cancel the booking. Payment once made is non refundable unless deemed necessary by the Company as specified in Clause 2.2 herein.
   2. Cancellation by the Company: The Company reserves the right to cancel orders within 28 days of booking. In the event of cancellation, the Company will communicate this to the Client and refund 100% payment within a period of 48 hours of providing information of cancellation.
   3.  Order Confirmation: If the Company does not communicate the cancellation within 28 days from the date of payment by the client, the order will be considered as ‘Confirmed’ and the Company will be ready to deliver the said vehicle to the Customer as per its specified delivery schedule below in clause 4.

3. Payment Terms

   1. Payment Deadline: Once the order is confirmed, the Client agrees to make the complete payment of the pending amount of Rs 15,00,000/- through NEFT / RTGS to the Company. This payment must be completed before 1st April 2024. Failure to Make full balance payment of Rs. 15,00,000/- will result in cancellation of the order without possibility of Refund of any and all amounts paid by the client to the company before 1st April 2024.

4.  Delivery Schedule

   1. Commencement: Deliveries of the orders will commence from 1st April 2024.
   2. Priority: Deliveries will be conducted on a first-come, first-served basis.

General Terms:

Modification of Terms: The Company reserves the right to modify these Terms at any time without prior notice. Clients are encouraged to review these Terms regularly.

Governing Law: These Terms are governed by and interpreted in accordance with the laws of India. Any disputes arising from these Terms will be subject to the exclusive jurisdiction of the courts located in Pune, Maharashtra.

Communication: All communication regarding bookings, cancellations, and payments will be conducted through the contact information provided by the Client. The company is not responsible if the client fails to provide inaccurate information leading to cancellation of the order without possibility of Refund.

By booking an order with the Company, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.

Delays: The Company is not responsible for Delays that may occur as a result of Policy Changes, RTO Registration Processes and hurdles, or any other external factors that are out of control of the management of the Company.

Other Terms and Conditions: Terms and Conditions that may not be mentioned here apply when the vehicle is invoiced / sold to the customer, that are related to Services, Sales, Warranties, Safe Use and Operation, Load Body / Accessory Fitment, Etc.
